These terms apply to the Trade Sites UK managed website service.

The service is provided to business customers only. By purchasing the service, you confirm that you are buying it for the purposes of your trade or business and not as a consumer.

1. How the service works

You can request a free website preview without payment or obligation.

If you decide to proceed, the contract begins when you make your first £49 payment. I will then complete the remaining setup, which may include registering your domain, configuring forms, analytics and other final website settings.

The monthly fee pays for an ongoing managed website service. It does not purchase the website by instalments, and ownership does not automatically transfer after any period of time.

2. What’s included

The standard service currently costs £49 per month and normally includes:

  • design and build of your website;
  • up to six main pages;
  • up to six individual service pages;
  • up to ten service-area pages;
  • website hosting;
  • one standard .co.uk domain;
  • SSL certificate;
  • website backups;
  • WordPress, theme and plugin maintenance;
  • basic on-page SEO setup;
  • website support; and
  • up to 15 minutes of minor text or image changes during each monthly billing period.

The exact pages and structure will depend on what is appropriate for your business.

The service-page and service-area allowances apply to the initial build. Additional pages requested later may be chargeable.

Unused website-change time does not roll over. The included allowance covers minor changes to existing text and images only.

New pages, redesign work, new functionality, ecommerce, substantial content work, ongoing SEO, advertising management and other work outside the standard service can be quoted separately.

Email accounts and email hosting are not included.

3. Payments

The subscription is charged monthly in advance through Stripe, normally on the same date each month.

PLNT Design Ltd is not currently VAT registered, so VAT is not currently charged. If VAT or another tax becomes legally payable, it may be added at the applicable rate.

If a payment fails, Stripe may retry it. If payment remains outstanding, I may suspend the website until the outstanding amount is paid.

Suspension for non-payment does not itself cancel your subscription.

4. Cancellation

You can cancel at any time with no minimum term and no notice period.

Your website will remain online until the end of the billing period you have already paid for and will then be taken offline.

Payments already made are not refunded simply because you cancel partway through a billing period.

Website files may be retained for up to 30 days after the service ends and may then be permanently deleted.

5. Domains

A standard .co.uk domain is included with the service and is registered in your name. While the service is active, PLNT Design Ltd manages the domain on your behalf, including the renewals, DNS and technical settings.

If the service ends, the domain remains yours. On request, I will transfer it to a registrar account of your choice.

If you already owned your domain before using Trade Sites UK, nothing changes, it stays in your name and under your control throughout.

If the service ends and no handover has been arranged, the domain will not be renewed at its next renewal date, and you are responsible for arranging renewal if you wish to keep it.

6. Website ownership

Unless otherwise agreed in writing, PLNT Design Ltd retains ownership of the website design, build, code and other material created as part of the managed service, to the extent that those elements are owned by PLNT Design Ltd.

While your subscription is active, you have the right to use the website as part of the service.

Material you supply, such as your logo, photographs and original text, remains yours.

Third-party themes, plugins, stock images, fonts, software and other licensed material remain subject to their respective licences and ownership terms.

A website buyout or transfer to another provider may be available by separate agreement and for an additional fee, but it is not included in the monthly subscription.

7. Content you provide

You are responsible for information and material you supply for the website.

You confirm that:

  • the information you provide is accurate;
  • you have permission to use any text, photographs, logos or other material you provide;
  • any accreditations, testimonials, qualifications and business claims are genuine; and
  • the material does not unlawfully infringe anyone else’s rights.

You give PLNT Design Ltd permission to use material you supply as necessary to build, host and operate your website.

You are responsible for checking the finished website for factual accuracy and telling me if anything needs correcting.

8. Changes and support

Support and the included monthly changes are provided within reasonable normal working availability.

Requests that fall outside the included service or require substantially more work can be quoted separately before the work is carried out.

I may refuse requests that are unlawful, technically unreasonable, harmful to the website or infrastructure, or outside the scope of the service.

9. Suspension or termination

I may suspend or terminate the service where reasonably necessary because of:

  • unpaid fees;
  • illegal, fraudulent or infringing content;
  • misuse of the website or hosting;
  • a security risk;
  • serious or repeated breach of these terms; or
  • circumstances that make it unlawful or impractical to continue providing the service.

Where reasonably possible, I will give you an opportunity to resolve a problem before terminating the service.

10. Third-party services

The service relies on third parties such as hosting providers, domain registrars, Cloudflare, WordPress, plugins, Google and other technology providers.

I am not responsible for outages, failures, changes or interruptions caused by third-party services or circumstances outside my reasonable control, although I will take reasonable steps to resolve problems affecting services I manage.

Backups are maintained as part of the service, but they should not be treated as a permanent archive of every previous version of your website or content.

11. Results

I will use reasonable care and skill in providing the service, but I cannot guarantee:

  • particular Google or other search-engine rankings;
  • a particular amount of website traffic;
  • enquiries, leads or sales;
  • acceptance or continued inclusion in search engines; or
  • uninterrupted or 100% website uptime.

Search engines and third-party platforms ultimately control their own rankings, systems and services.

12. Portfolio and website credit

Unless otherwise agreed, I may display the website and reasonable screenshots of it in my portfolio, case studies and marketing.

I may also include a discreet “Website by Trade Sites UK” or similar credit and link in the website footer.

13. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

To the extent permitted by law, PLNT Design Ltd is not liable for indirect or consequential losses, loss of profits, loss of business, loss of anticipated savings or loss resulting from matters outside its reasonable control.

PLNT Design Ltd’s total liability arising from the service will not exceed an amount equal to 12 months of the subscription fee in force when the liability arose.

14. Price and terms changes

I may change the subscription price by giving at least 30 days’ notice.

If you do not wish to continue at the new price, you can cancel before it takes effect.

I may also update these terms where reasonably necessary to reflect changes to the service, suppliers, law or business operations. Material changes affecting an existing subscription will be communicated before they take effect.

15. General

I may use third-party suppliers or subcontractors to help provide the service while remaining responsible for the services I have agreed to provide.

If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

These terms, together with anything specifically agreed with you in writing, form the agreement between you and PLNT Design Ltd for the Trade Sites UK service.

If a dispute arises, please contact me first so that we can try to resolve it directly.

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over disputes relating to them.
